Courts will change a joint custody arrangement if communication between the parents regarding the child deteriorates. The courts expect the parents in joint custody situations to maintain communication regarding the child's education, religion, medical and other issues. Once parents can not communicate, the courts usually change the custody situation from joint to sole custody. Sole custody will be given to the parent it determines was not interfering with communication. Interference with communication regarding the child is actually like a parent preventing access to the child, and preventing access to the child or information about the child is a serious issue as every child deserves the attention of both parents. The process to change custody because of such interference is commenced by a Petition usually to the Family Court for a change in custody.
